The estate of Absalom Holland, 7th child of Elisha Holland and Patience Watkins, 
born about 1801 in North Carolina, died 7 January 1863, in Wayne County, North Carolina, at age 62.  He was survived by his wife Nancy Hales and nine children.  He did not leave a will.

To the Worshipful, the Justices of the Court of Pleas and Quarter Sessions, of Wayne County:

THE PETITION OF Nancy Holland widow of Absalom Holland deceased, of the County of Wayne humbly complaining, sheweth unto your Worships, that the said Apsolom Holland departed this life on the 7 day of January A. D. 1863 intestate, leaving him surviving, your petitioner, his widow.

Your petitioner further sheweth, that the said intestate died possessed of and well entitled to, a considerable personal estate, and that at the present term of this Worshipful Court, Nancy Holland hath obtained letters of Administration of the goods and chattels, rights and credits of the said intestate, to be granted to her and hath by virtue thereof possessed himself, of the personal estate and effects of the said intestate to a large amount, and much more than sufficient to pay his funeral expenses.

Your petitioner further sheweth, that by virtue of the statue in such cases made and provided, she is entitled as a widow of said intestate, to an adequate support for herself and family, for the space of one year, out of the crop, stock and provisions that may be on hand belonging to the estate of the said intestate, and if there should be no crop, stock or provisions on hand, or not a sufficiency to afford such allowance, to have the value of a years’ provisions for herself and family estimated, and the same allotted and set apart to her, to be paid to your petitioner or allowed by the said administrat[????] of the said intestate, and in addition to said years’ support, your petitioner is also entitled to one bed and its necessary furniture, one wheel and one pair of cards, if such articles be among her Goods of the said deceased husband, as her absolute property, and to be put in possession of the same.

Your petitioner therefore prays your Worships to appoint one Justice of the Peace, and three freeholders, unconnected with your petitioner, to view the estate of her said deceased husband, and to give, allot and apportion to your petitioner and family, so much or such part thereof as they may deem necessary for the support of your petitioner and family, for one year, and no more; and that your Worships would confirm the same by the order and decree of this Worshipful Court, and grant unto your petitioner, such other further relief, according to the act of the General Assembly of this State, in such cases made and provided, as the circumstances of this case may require, and to your Worships shall seem meet. And your petitioner will ever pray, &c.

To the sheriff of Wayne County – GREETING:

You are hereby commanded to summon a Jury of five Freeholders to lay off and allot to Nancy Holland, widow of Absalom Holland, deceased, one-third part of the lands the said Absalom Holland died seized and possessed of, viz: one track of land adjourning the lands of Woodard Holland and others containing about three hundred and fifty acres.

And your proceedings report to the next Term of our said Court, to be held at the Court House in Goldsboro, on the third Monday of Feby next. Herein fail not, and have you then and there this Writ.

STATE OF NORTH CAROLINA                                     Wayne County.

To the Worshipful, the Justices of the Court of Pleas and Quarter Sessions:

The Petition of Nancy Holland respectfully showeth to your Worships, that some time in or about the month of Jany 1863 Apsalom [sic] Holland died intestate, seized and possessed of the following lands, tenements, and hereditaments, viz:  about two hundred & fifty acres mor or less adjoins the lands of Wood Holland & others.

And that, by his death, the said lands, tenements and hereditaments descended to Burdin Holland Ruf & Somon Holland, Elizabeth, William, Richard Holland, Zilpha, Apsalom & Nancy Holland the defendants hereinafter named heirs at law of the said Apsalom Holland.  That at the time of his death the said Aps Holland most usually dwelt in the said county of Wayne; that at the time of his death he left your petitioner his widow; that your petitioner as such is entitled to one-third part of the said lands and tenements, for her natural life, for her dower; and is desirous of having the same laid off and allotted in severalty to her, and of being put in possession of the same; that your Worships would issue your writ to the Sheriff of the said county of Wayne commanding him to summon five free-holders unconnected with your petitioner and the said heirs at law of the said dec….. either by consanguinity or affinity, and entirely disinterested, who, upon oath, shall allot and set off to your petitioner the one-third part of the said lands, tenements, and hereditaments, wherof the said Apsalom Holland died as aforesaid seized and possessed, together with the house or mansion, or part or portion thereof in which said Apsalom Holland dwelt most generally next before his decease, and of all out-houses, buildings and improvements thereunto belonging, or in any way appertaining, and put her in possession thereof, according to the form of the Statue in that case made and provided.

     To this end, therefore, that the said defendants, heirs at law as aforesaid, of the said Absalom Holland may appear and answer this petition, your petitioner prays that your Worships would cause a copy of this petition to be served on them together with your writ of subpoena, commanding them, under a certain penalty, to appear at the next term of your Worshipful Court, and answer this petition, and show cause, if any they have, why the prayer of your petitioner should not be granted. And your petitioner will ever pray, etc.

THE Petition of Burdin Holland, Rufus, Simon. William, Richard, Elizabeth, Zilpha Apsalom, Nancy Holland of said County, respectfully sheweth unto your Worships, that Apsolom Holland of the County of Wayne deceased, was in his lifetime, and at the time of his death, seized in fee simple or of some other good estate, of inheritance to him and his heirs, of a tract of land about two hundred & fifty or sixty acres more or less ad…..[illegible] the land of Needham Holland, B. G. [illegible] ….others on the great marsh.

All which said land are situate, lying and being in the County of Wayne and being so seized, the said Apsalom Holland did depart this life intestate, leaving Burdin Rufus Simon William Richard Elizabeth Zilpha Absalom Nancy Holland him surviving; and upon his death the said lands descended and came to your petitioners as tenants in common in the proportion of one ninth part.

Your petitioners further shew unto your Worships, that they are desirous of having a fair, just and equal partition of the said lands made between them, in order that their respective shares and proportions thereof, may be allotted, held and enjoyed in severalty.

To the end therefore, that a partition may be made of the said lands between your petitioners; that each one's share or proportion thereof may be allotted and conveyed to them and their heirs and assigns; and that your petitioners may severally hold and enjoy their respective allotments of said lands, according to the nature thereof, in severalty and that all proper and necessary conveyances and assurances may be executed for carrying such partition into effect. And that your petitioners may have such other and further relief in the premises as the nature and circumstances of this case may require, and to your Worships shall seem meet. May it please your Worships to appoint five commissioners, to divide and appropriate said lands between your petitioners, as herein before prayed for, according to the act of the General Assembly in [cut off]

Commissioners to go upon the premises and divide a certain tract or parcel of land lying in Wayne County, viz: adjoining the lands of Needham Holland B. G. Barnes Jese Roses [or Rose] and others on the great marsh containing about two [or 2100] hundred and fifty-six acres more or less between Burdin, Rufus, Simon, William, Richard, Elizabeth, Zilpha, Absalom and Nancy Holland heirs at law of Absalom Holland in the following proportion: of one ninth to each.

And your proceedings report to the next Term of this Court, to be held at the Court House in Goldsboro, on the third Monday of May next. Herein fail not, and have you then and there this Writ.
