FEBRUARY 1850 WAYNE COUNTY COURT

2/50 120 Ordered that Bunyan Barnes be appointed guardian of Amy Ann Pipkin and Mary Helen Pipkin upon his entering into bond in the sum of two hundred fifty dollars.

2/50 121 Exum Holland Guardian of Elizabeth, Jonathan & Joanna Copeland came into court and renewed his bond in the sum of $500 with Jinnett Holland and West Holland securities.

2/50 134 Ordered that Jno. G. Barnes be appointed overseer of the road leading from Cross roads near Jacob Peacock to the old road near the Bizzell place and the usual hand work thereon.

2/50 136 A deed of sale from Gabriel Davis to Burket Barnes duly proven in open court by the oath of Henry M. Thomson a subscribing witness ordered that it be registered.

2/50 137 A deed of sale from William Pope to Jesse Coleman and Burket Barnes duly proven in open court by the oath of Henry Pope a subscribing witness ordered that it be registered.

5/50 154 Ordered that the following persons be appointed inspectors to hold the election in their respective districts on the 1st Thursday in August next for electing a Sheriff and ministry? to the Court legislations for this county vize:

8/50 167 Ordered that S & W Barnes & Co. have lien to retail spirits at Nahunta one year.

8/50 168 Ordered that William Barnes have lien to retail spirits at the Black Creek depot one year.

8/50 174 Item 56 James Brown, Endorser vs. Benja. Barnes et al. - Same jury charged and find all issues in favor of the plaintiff and assess his damages for interest to the sum of $32.48 for principal debt to $334.88. Judgment for same and for costs.

8/50 175 Item 58 James D. Barnes vs. Thomas Hadley - Same jury charged and find all issues in favor of the plaintiff and assess his damages for interest to the sum of $20.71 for principal debt to the sum of $210.66. Judgment for same and for costs.

8/50 175 Item 60 James D. Barnes vs. Thomas Hadley - Pleas withdrawn. Judgment final by default according to specialty filed for $655.08 in principal and carrying in to be paid and for costs. Whereupon deft. appealed. W.H. Gardner_____

8/50 175 Item 62 James Brown vs. Elias Barnes - Same jury charge and find all issues in favor of the plaintiff and assess his damages for interest to the sum of $29.03 and for principal debt to $301.40. Judgment for the sum of $330.43 and for costs.

8/50 180 Jno C. Barnes and Jonathan Barnes were summoned to courthouse in Goldsboro for jury duty for September court.

8/50 183 State of North Carolina & Sarah Harrison vs. Elias Barnes & Jacob Woodard -- Pleas withdrawn. Judgment by default for $8.90 former?? cash?? and cost of this suit.

 

NOVEMBER 1850 WAYNE COUNTY COURT

Third Monday, 18th day, Goldsboro

11/50 189 Ordered that Elisha Pope be appointed overseer of the road from the branch near Charity Barnes to Black Creek Bridge near Ichabod Pearson’s mill and the usual hand work thereon.

11/50 191 State vs. Elias Barnes - Deft. submits. Ordered and adjudged by the court that the deft. pay a fine of one dollar and costs.

11/50 194 State by Nancy Holland vs. Elias Bass & Washington Hooks & Burden Aycock - Defts called and failed as bond. Judgment according to necgnyame??? for the sum of $200 ___ seifa?? not asseor?? bond given see entries at this time.

11/50 200 Ordered that Bunyan Barnes be appointed administrator upon the estate of Sarah Baker upon his entering into bond with the sum of $500 with Wiley Daniel & Henry Martin. Sum bond given adm qualified.

11/50 201 Ordered that Farmer Barefoot have lien to retail spirits at distillery of Elias Barnes for one year.

11/50 202 #11 Benja. Barnes and #13 Drew Barnes summoned for jury duty following 3rd Monday of February next.

11/50 202 State by Nancy Holland vs. Elias Bass - Bastard. It appearing with satisfaction to the court that the child of Nancy Holland wherewith she has charged the defendant is now born and by the admission of the defendant that he is the father thereof. The court doth order and adjudge that he enter into bond with securities as required by law and it is further ordered and adjudged that the said Elias Bass pay into court further with to the use of the said Nancy Holland ten dollars for her lying in month and twelve dollars annually for each year hereafter for seven successive years for the support of the said bastard child and that he pay the costs of these proceedings.

2/51 217 State vs. Stephen W. Barnes - The following jury sworn and charged vize Moe Williams, Jesse Deans, Council Scott, Arthur Barden, Martin Johnson, Daniel Grant, Calivn Aycock, Jas Lewis, Alia? Herring, Daniel Barden, Stephen Pate, and Benj Strickland who find deft guilty. Ordered and adjudged by the court that the deft pay a fine of $1.00 and costs.

2/51 218 Ordered that Jno. G. Barnes be appointed guardian of Elizabeth Barnes and Enos Barnes minor heirs of William Barnes upon giving bond in the sum of twenty five hundred dollars with David Barden and William Simms securities.

2/51 218 A deed of sale from Burket Barnes to Rhody Read duly acknowledged in open court that it be registered.

5/51 240 mention of Bennet Barnes jury duty

5/51 241 Daniel Aycock, John Bass, Jacob Bass, Hardy Hooks, William G. Sumerlin, Bunden T. Aycock, Simon Aycock, Wiley Barnes be appointed patrols for the Nahunta district – to ride at pleasure without pay.

5/51 242 Inventory and account of sales of William Barnes returned and ordered to be recorded.

5/51 247 State vs. William Sampson? & Jno. W. Barnes - Same jury as above charged and find defts guilty. Judgment suspended on payment of costs.

5/51 249 Henry Pope vs. William W. Barnes – The following jury vize: Jno. R. Tilton, William Exum, Sander Lancaster, Micajah Casey, Irwin King, Ingram Rhodes, D. T. Durham, Spias Best, James Jernigen, Bennet Barnes & Jesse Martin & John Kennedy & find all the issues in favor of the defendant. Judgment again the plaintiff for costs. Whereupon the plaintiff made and obtained an appeal to the next superior court.

5/51 249 Theo T. Simms by Mort? Green, his administrator vs. William N. Barnes - Same jury as above except John Kennedy and Irwin King. William Kornegay and Arthur Copeland in their places. Charged and find all issues in favor of the defendant. Judgment – plaintiff for costs.

5/51 253 Bunyan R. Barnes vs. Elias Barnes - The following jury viz: Nathan Boyte, Jno Hill, Fred Cox, David James, Sanders Lancaster, Spiras Best, Mathew Casey, William Exum, Micajah Cox, John T. Kennedy, Jno R. Tilton, & James Jernigan charged who find all issues in favor of the plaintiff and assess his damages in the sum of $106.44 of which sum $96.40 principal money. Judgment for same and costs.

5/51 254 Order that Elias Ferrell be appointed overseer of the road leading from Elias Barnes still to the Johnston County line and the usual hand work thereon.

Barnes be appointed overseer of the road leading from the lane near Mrs. Dickinson and runs by Nahunta depot to the Smithfield road and all the hands living in the following boundaries with thereon vize: beginning at the mouth of the Dickenson lane and runs down the ---- which branches to Aycock Swamp then up said Swamp to the head then on to the head of Wolfbranch then down said branch to the Smithfield road and with the road to the beginning.

8/51 270 Ordered that Stephen Barnes lien to retail spirits at Nahunta depot for one year.

8/51 270 Henry Lucas guardian of Henry and Sally Lucas came into court and renewed his bond in sum of one thousand dollars with Thos. Tomblinson and Josiah Barnes securities.

8/51 270 Ordered that Francis Artis age two years be bound to Isaac Aycock until he arrives at lawful age. Stephen W. Barnes and Jesse Coleman securities.

8/51 273 Wiliam Bass guardian of Mary, Nancy, and Nilen? and William Bass came into court and renewed his bond in the sum of five hundred dollars with Jonathan Barnes and John Hays securities.

8/51 273 Ordered that William Barnes have lien to retail spirits at Black Creek for one year.

8/51 277 State vs. Henry Mitchell and Stephen W. Barnes – Defendants acknowledge themselves in debt to the State of North Carolina in the sum of one hundred dollars each to be levied of their goods and chattels, land and tenements to be void upon condition H. Mitchell makes his personal appearance at the next term of this court and not depart without leave.

8/51 280 Ordered that Daniel Aycock, William Bryan, William Barden, Jesse Fulgham, Joshua Aycock, Barden Hooks, William N. Barnes, James Aycock, Mordecai Bass and Isaac Aycock be appointed patrolls for Nahunta District to serve without pay.

8/51 280 Ordered that Bunyan Barnes, Henry Pope and Jacob Daniel be appointed commissioners to let out the repairs of the bridge across Contentnea or that portion of it kept up by the county of Wayne and make report to the next term of this court.

The court doth order and adjudge that he enter into bond with surety as required by law. It is further ordered and adjudged that defendant Ruffin Barnes pay into the court forthwith for the use of Nancy Tomlinson the sum of ten dollars for her lying in month and twelve dollars annually for each year hereto for seven successive years for the support of the said bastard child and that he pay the costs of these proceedings.
